About Other Claim Areas

While the False Claims Act (FCA)and Security and Exchange Commission(SEC) Whistleblower laws are two of the most prominent and used qui tam laws in the US, they are by no means the only laws that reward and protect whistleblowers, nor are some of the common claims we’ve listed anywhere near exhaustive. Ethic Alliance can support a much wider variety of whistleblower claims, including, but not limited to, claims that fall under:

  • The Foreign Corrupt Practices Act (FCPA), which makes it unlawful for any US person or company to offer, pay, or promise to pay money or anything of value to any foreign official for the purpose of obtaining or retaining business; IRS Whistleblower Law, which provides rewards between 15 percent up to 30 percent to whistleblowers for reporting instances of tax evasion and other tax law violations.

  • The FCA and FCPA can be used to combat criminal activity related to environmental crimes such as illegal fishing, logging, and wildlife tracking. Various environmental and wildlife trafficking laws include reward provisions such as the:

    • Endangered Species Act and Act to Prevent Pollution from Ships (APPS).

  • Whistleblower protections are also written into six environmental statutes including the:

    • Clean Water Act (CWA)

    • Clean Air Act (CAA)

    • Safe Drinking Water Act (SDWA)

    • Toxic Substances Control Act (TSCA)

    • Solid Waste Disposal Act (SWDA)

    • Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA).

  • Many US states also have qui tam and anti-retaliations laws.
